They don't lawyer up because: 1) They think they are smart and can talk their way out of it 2) They think they are smarter than the cops 3) They are socio and/or psychopaths and don't think that far into the future (about the trial and consequences) 4) Some of them like talking about the crime again 5) Some of them just aren't smart enough to know better 6) Cops know how to get them to talk (by pretending to be their friends, confess you'll feel better, etc etc)

Right you know, and I always wonder about the dynamics of the interogation roomitself...does the mere fact that there are ACTUALLY AND FOR REAL!!!!!! people filming and recording them (in most places??) intimidate criminals or excite them more? Or even incite them more?

I AGREE WITH MAW. I DON'T CARE WHAT NEIGHBORHOOD YOU GREW UP IN OR WHERE YOU ARE FROM. YOU SHOULD KNOW YOU'RE RIGHTS AS AN AMERICAN CITIZEN. AND EVEN IF YOU'VE BEEN UNDER A ROCK AND DON'T, THEY DON'T ARREST YOU WITHOUT GIVING THEM TO YOU. EVEN IF I WERE A WITNESS, I WOULD HAVE LEGAL REPRESENTATION. IF YOU'RE OLD ENOUGH TO CARRY AND USE A WEAPON, YOU SHOULD AT LEAST KNOW TO HAVE AN ATTORNEY PRESENT.

Some people who commit a crime want to confess. The ten to twenty percent who are the hardcore type, know the system and will lawyer up right away. However, strange as it seems, some first time criminals want to tell the truth, to get it off their backs, to releave their conscience. They want to believe that the detectives are their friends and will help them through this... There is also the excitement of the mental battle between the perp. and the detective. Who wants that to end? I'm smarter than those cops...I'll get them on my side and then they'll set me free... Either way, if criminals were smart, there would not be a show. Whatever the case, do not lawyer up.

It never ceases to amaze me how some suspects think if they just say "I didn't do it", they will go home and live happily ever after doin' what their doin'. Maybe they think if they ask for a lawyer, it's bascially saying "I'm guilty." So, they just hang in there, keep saying they didn't do it and hope that the detectives just give up and let 'em go. Maybe they feel confident that no one would dare to snitch on them and they know they hid or got rid of the weapon in a really good hidy hole, so the police couldn't have s*it on them. It challenges the detectives to show their evidence to "prove it." Most of the time, if the detectives say they have a witness or found the weapon, it's to late, they are too dumfounded to even think to ask for a lawyer. lol However, I have seen more than once, the detectives show their evidence and the perp lawyers up. -- Edited by belfegore_insider at 12/23/2008 6:58 AM PST

Most of these people are career criminals, I'm sure they're aware of their rights and that they have access to a lawyer even if they cannot afford as such. If the evidence is against you, it doesn't really matter who you get as a lawyer, IMO. I don't think that they all know that they are entitled to a public defender. They otherwise probably don't have access to a lawyer or the money to pay their own lawyer. That's what happens when you don't know the law.

C'mon.... The answer is...they are just plain stupid. Each of these guys (and gals) thinks they can talk their way out of whatever. Most think they're smarter than the cop sitting across from them and think they can go home if they just hit the right combination of words. They've been able to talk their way out of issues with mom (and dad if there's a dad around) all their lives, why not the cops? Why would ANYONE say ANYTHING? Damn, if I was arrested for anything more than a traffic ticket, I would ask for a lawyer. common sense SHOULD tell these jerks that.....but most are just too stupid. Kind of like those that are willing to go a step further and admit to robbery (but not the homicide that their friend did). EVERY STATE IN THE UNION puts equal blame regardless of who pulled the trigger. Yet these guys seem to think they can get away with it if they blame it on the co-defendants. Even if you STRONGLY STRONGLY STRONGLY believe you have a case of justifiable homicide or self-defense....you should STILL GET A LAWYER and DO NOT TRY TO CONVINCE THE HOMICIDE DETECTIVES OF THIS! In other words, you should never even BE IN THE INTERROGATION ROOM! You should have asked for a lawyer long before reaching that room!

I think it's a combination of several factors as to why they don't lawyer-up. Could be the interrogation room "talents" of the detectives and their ability to convince the suspect that it is "the best way" to go ahead and "get it out of their system". Watching this show, there are some detectives who are very keen and skilled at digging into the frame of mind these suspects are in when they step into that interrogation room. Also, although it may play a lesser part, the "15 minutes of fame" bit, being televised, might appeal to some of the not-thinking suspects. They may have a mindset that they can show their innocence in front of a camera. Ultimately, unless the suspect is very skilled in mind games, if I were the suspect, I'd lawyer-up right away. The detectives are pretty good at all the scenarios from lots of practice.

do they not know their rights? i know they are bad people and do very vile things. if i were in their situation facing somebody like kevin lundy, staring at me like a rock i would definitely consult a lawyer and let the legal system work it out. i've only seen one person get a lawyer and never give a statement. more people should do it.
