especially when evidence comes to light that the conviction was wrong....yet they refuse to act upon it to save face.
they SHOULD be jailed as a CRIMINAL as thier actions are criminal.
thier time should be served in general population not protective custody for the duration....that might stop these hasty career making convictions and start a new level of honest judicial practise

If a prosecutor withheld mitigating evidence or knowingly presented false evidence, then the prosecutor should serve the sentence the wronged person received.

There was a prosecutor in Ohio, where all the cases he tried were reopened because of questionable ethics long after he left office. I remember reading a series of articles in (The Cleveland Plain Dealer) a few years back. The Ohio Supreme Court ordered all his cases be reviewed. I believe he was charged for withholding evidence in one paricular case. I've been looking for the other findings in the paper ever since, but I don't know how it came out, rather it's time consuming or they're dragging their feet. Could be it may shed more light on the practice of prosecutors in the justice system. It's all political.
The judges, the lawyers and the prosecutors.

There have been court cases in which the state's prosecutors supressed evidence that could have meant the defendant would be found not guilty, yet they didn't give it to the defense attorneys. There have been other cases, one I know of personally, in which the prosecutors pile charge upon charge upon the defendant, hoping that the defendant will plead guilty because they're afraid of getting life in prison. (In these cases, the defendants ARE guilty, but not of ALL the charges pressed by the prosecutors.) Then there are prosecutors who drag their heels when defense attorneys wish to have post conviction DNA tests completed for their clients.

All of these prosecutors are not serving the public interest and should be jailed for professional malpractice. What tees me off as a citizen is that innocent people are being jailed or guilty people are being jailed for too many years so that a prosecutor can make their career. It should be about jailing the guilty, finding the innocent not guilty and setting the appropriate punishment.

Branson, are you assuming the prosecutors KNEW the accused was innocent, that they falsified evidence and knowingly convicted an innocent person? That's far different than convicting an innocent person due to faulty eye witness accounts or other mistakes. Using your question as a basis, the system might just as well not prosecute anyone, ever, for any crime, firsthand eye witness testimony or not.

How about the police that build the case? Aren't prosecutors assigned the cases? How about the politico's that assign the cases to the prosecutors? Are they all responsible?

PROSECUTORS SHOULD SERVE THE SAME TIME AS INNOCENT

Nov 24, 2006 11:21 PM
Very Simple, if a person is found innocent and say served 15 years in prison, then the prosecutor should serve the same time in prison!
Poll
THE COPS, THE PROSECUTORS, AND DEFENSE ATTORNEYS
EVERYONE IN THE CASE SHOULD BE ACCOUNTABLE FOR A WRONG CONVICTION. IF THEY WOULD NOT RUSH INTO GETTING SOMEONE THEN THEY COULD GET THE RIGHT5 PERSON FOR THE CRIME.
